Landlord Forms and Required Wording in Nova Scotia
Which official forms a Nova Scotia landlord uses for the lease, rent increases and ending a tenancy.
Last updated: October 2026
Short answer
Nova Scotia requires the standard lease (Form P), and a rent increase notice has no prescribed form but must state the amount and effective date. Notices to quit use forms such as D, E, F and DR2, and the Director's forms are on the province's website.
Which forms a Nova Scotia landlord uses
Nova Scotia is a forms province. Some forms are mandatory, some are optional, and a few are used only when a dispute reaches the Director. The ones in the research are:
- Form P, the standard form of lease. Mandatory.
- No form for a landlord's rent increase notice. A written notice with the required contents is enough.
- Forms D, E, F and DR2 for landlord notices to quit. Form C is the tenant's notice to quit.
- Forms J, K and R for applications and the deposit claim.
- Forms A and B for abandoned belongings.
The province lists its current forms on the residential tenancy forms page. Copy the exact wording and fields from the form itself, not from a summary. For the rent increase and notice processes in detail, read raising rent in Nova Scotia and ending a tenancy in Nova Scotia. This guide covers only which form goes where.
The lease: Form P
The Residential Tenancies Act lets the Director prescribe a standard form of lease that all landlords and tenants must use (s. 8(2A)). That form is Form P, "Standard Form of Lease", in the Standard Form of Lease Regulations, N.S. Reg. 19/2025. Standard Form of Lease Regulations
- Your own layout is allowed. The Form P guide says your lease may look different, but it must contain every item in Form P. If an item is missing, it applies anyway.
- You cannot delete or change the required terms. Any alteration of, or deletion from, the required provisions is void (s. 8(3)).
- Extra terms are allowed if they do not conflict with the Act (s. 8(1)). They are void unless they appear on both parties' copies (s. 8(2)).
- If you skip the form, a written lease without it is treated as if the standard form was signed, and the Act and the standard form apply (s. 8(4)). An oral agreement is treated the same way (s. 8(5)).
- Copies. Give the tenant a signed copy at signing or within 10 days, and a copy of the Act within 10 days of the earliest of the lease start, signing, key handover or move-in (s. 7). If you do not, the tenant may give notice to quit on a day of their choosing up to three months out, or apply to pay rent in trust to the Director.
Form P also carries the statutory conditions in Schedule A (clause 20), deposit terms (clause 18) and a recommendation to prepare a written inspection report within 7 days of the start and end of the tenancy (clause 19). Services listed in clause 16 count as rent: deleting one is deemed a rent increase. For the tenant's view, see Nova Scotia lease agreements.
Rent increase notice: no form, but required contents
No prescribed form was found for a landlord's rent increase notice. The Act sets what the notice has to do: it must be in writing and state the amount and the effective date of the increase (s. 11(2)).
| Type of lease | Notice before the effective date |
|---|---|
| Year-to-year | 4 months |
| Month-to-month | 4 months |
| Week-to-week | 8 weeks |
| Fixed term | No separate notice. The lease itself must state the amount and effective dates of any increases. |
You cannot raise the rent in the first 12 months, or more than once in any 12-month period (s. 11). For 2026 and 2027, the Interim Residential Rental Increase Cap Act limits an existing tenant's increase to 5 percent above what they were legally required to pay in the preceding 12 months. Interim Residential Rental Increase Cap Act Because the cap applies when you sign a new fixed-term lease with an existing tenant in the same unit, a new lease is not a way around it. Check the official page for the figure that applies on the date of your notice.
Forms for ending a tenancy
| Form | Used for | Key timing in the research |
|---|---|---|
| Form C | Tenant's notice to quit | Year-to-year: 3 months. Month-to-month: 1 month. Week-to-week: 1 week. |
| Form D | Landlord's notice to quit for unpaid rent | Allowed from the 4th day after rent was due. Effective no earlier than the 10th day after it is given. The tenant has 10 days to pay (the notice is void) or to apply to set it aside. |
| Form E | Breach of good behaviour or cleanliness and damage conditions, or subletting without consent | Effective no earlier than 15 days after it is given (30 days in a land-lease community). |
| Form F | Other grounds in s. 10(8), such as a student who stops being a student, employee housing after the job ends, or premises made uninhabitable | Follow the Act rather than the official guide's summary list, which differs slightly. |
| Form DR2 | Sale, 4 or fewer units, buyer or family moving in | At least 2 months after the tenant receives it. |
| Form DR5 | Demolition or renovation by mutual agreement | Without agreement, the Director must make an order. |
| Form J | Application to the Director when a tenant will not leave | Fee $31.15. |
| Form K | Unpaid rent order without a hearing | Only if the tenant did not dispute the Form D. |
| Form R | Security deposit claim | File within 10 days of the lease ending. |
The Act is the controlling source for grounds and dates. Residential Tenancies Act, s. 10 A landlord cannot give a notice to quit except in accordance with that section (s. 10(3A)), and no immediate same-day notice was found.
Serving the forms, and what makes them fail
The research gives service details for some documents but not all. What it does record:
- Form J. Serve the tenant with the Form J and the Notice of Hearing, and return a Certificate of Service to the Residential Tenancies Program within 7 days of applying.
- Form R. Send a copy to the tenant by registered mail, express post or courier, or electronically if the lease gives an electronic address.
- Form A. Mail it to the tenant by registered mail, express post or courier, by email if an address is on the lease, or to the next of kin named in the lease.
- Entry notices. Delivery follows s. 15(2) of the Act or a text to a phone number the tenant gave for that purpose.
The research did not copy the service methods for Forms D, E, F and DR2. Read the form's own instructions and the Ending a Tenancy guide before you serve.
What commonly makes a notice fail:
- Using a ground the Act does not allow. A landlord who wants to move in, renovate or demolish needs an order, not just a notice.
- Rent that is paid within the 10 days after a Form D. The notice becomes void.
- Using Form K when the tenant disputed the Form D. There is no hearing for Form K, so it cannot be used then.
- Altering or deleting a required Form P term. That change is void.
This guide explains the rules in general terms; for a specific case, ask the tribunal or a licensed legal professional.
Frequently Asked Questions
Is there a lease form I must use in Nova Scotia?
Yes. Form P, the Standard Form of Lease (N.S. Reg. 19/2025), must be used under s. 8(2A) of the Act. Your own layout is fine if it contains every item in Form P.
What if I use my own lease instead of Form P?
A written lease that does not use the standard form is treated as if the standard form was signed, so the Act and the standard form apply. Any missing items apply anyway.
Is there a form for a rent increase notice in Nova Scotia?
No prescribed form was found. The notice must be in writing and state the amount and the effective date of the increase.
How much notice do I give for a rent increase?
Four months for month-to-month and year-to-year leases, and eight weeks for week-to-week. For a fixed-term lease, the lease itself must state the increases and their dates.
Which form do I use for unpaid rent?
Form D, the notice to quit. It can be given from the 4th day after rent was due and is effective no earlier than the 10th day after it is given. The tenant can pay within 10 days to void it.
What is Form E?
It is a notice to quit for breach of the good behaviour or cleanliness and damage conditions, or for subletting without consent. It is effective no earlier than 15 days after it is given.
What do I file if a tenant will not leave after a notice?
An application to the Director on Form J. The fee is $31.15. For unpaid rent, Form K is a no-hearing option, but only if the tenant did not dispute the Form D.
Where do I find the current forms?
On the Nova Scotia residential tenancy forms page. Copy exact wording from the form itself, and check the page for the current version before you use one.
