Can I break my lease before I move in?
Last updated: October 15, 2026
Short answer
Usually not by right. In the Acts we reviewed, we found no cooling-off period and no right to cancel a signed lease before the move-in date, so treat a signed fixed-term lease as binding and ask the landlord in writing for a release. What happens to money you paid before move-in differs by province: Ontario says a rent deposit must be repaid if you do not get vacant possession, and Nova Scotia treats money taken before the lease is signed as a security deposit. If the landlord keeps the unit empty and claims a loss, each of the nine provinces covered here puts some duty on it to keep that loss down, though the wording differs by province.
Is there a cooling-off period?
We checked the nine provinces covered here and found no rule that gives a tenant a period to cancel a signed lease, before or after move-in. The days before move-in are not treated differently from the days after in the Acts we reviewed. Oral and implied agreements are also covered by the Acts, so an agreement to rent can bind you even without a long written lease.
British Columbia's government page on deposits says paying the deposit establishes the tenancy, which means a tenancy can exist before you move in. In Ontario, the standard lease must be signed on or before the day the tenant may move in.
The rules for the other exits (violence, landlord breach, assignment, sublet) are the same as for any lease. See how to get out of a lease agreement and what to do if the landlord says you can't break the lease.
What to do if you want out before move-in
SQRFT advice, not law:
- Read the lease and any holding agreement. Look for the start date, what you paid, and any clause about cancelling.
- Tell the landlord right away, in writing. The sooner the landlord knows, the easier it is to re-rent, and a landlord claiming a loss generally has some duty to keep it down (the wording differs by province).
- Ask for a written release that says the lease is cancelled and what happens to any money you paid. Keep a copy.
- Offer a replacement tenant if you can. This may make it easier for the landlord to agree.
- Ask your tenancy office if the landlord refuses to return money you think is owed.

Money paid before move-in and the lease form, by province
| Province | Money paid before move-in | Written lease |
|---|---|---|
| Alberta | No holding-deposit rule found | Written, oral and implied agreements all covered; no mandatory form |
| British Columbia | No separate holding-deposit rule found; paying the deposit establishes the tenancy | The landlord must prepare a written agreement |
| Manitoba | No holding-deposit section in the Act; a security deposit cannot be required until the agreement is made | Oral, written and implied agreements valid; written required only with a guarantor or tenant services |
| Saskatchewan | No specific rule found; a security deposit may be required only when the agreement is entered into | Written for a fixed term of three months or longer |
| Ontario | A rent deposit; repaid if the tenant does not get vacant possession (s.107(1)) | Standard lease for most private tenancies, signed on or before the move-in day |
| New Brunswick | No section names holding deposits; payments other than rent, a security deposit or a reasonable service amount are void (s.8(4)) | Written lease on the Standard Form; an unsigned or oral tenancy is deemed to be on it |
| Nova Scotia | Money taken before the lease is signed is considered a security deposit | Standard form mandatory; a lease without it, or an oral agreement, is treated as if the standard form was signed |
| Prince Edward Island | A separate holding deposit is not allowed | The landlord must prepare a written agreement (from April 8, 2023) |
| Newfoundland and Labrador | Not regulated by the Act; outside the office's jurisdiction | Written, oral or implied agreements covered; written notice of an oral or implied one within 10 days |
Cancelling a lease before move-in in each province
Alberta
We found no Alberta rule that gives a tenant the right to cancel a signed lease before move-in. Written, oral and implied agreements are all covered, and there is no mandatory form. We found no rule on holding deposits. The Act does not ban or cap application fees; the handbook only says a person who does not want to pay one does not have to apply.
Ask the landlord for a written release. The government says a landlord who claims rent for a fixed term that ended early must take reasonable steps to re-rent (the repudiation rules are in s.27). See can a landlord keep a holding deposit for more on deposits.
British Columbia
The landlord must prepare a written tenancy agreement, and it is an offence not to (s.95(1)(a)), but oral and implied agreements are still covered and the standard form (RTB-1) is not mandatory. The government's deposits page says paying the deposit establishes the tenancy. We found no separate rule on holding deposits. A security deposit is limited to half a month's rent, with a separate pet damage deposit of up to half a month. Application fees are not allowed.
We found no cooling-off period. If you want out, ask for a mutual agreement to end the tenancy (the RTB-8 form). A party who claims compensation for a loss must do whatever is reasonable to minimize it (s.7(2)).
Manitoba
The Manitoba Act has no section on holding deposits. Application fees are banned, and a security deposit cannot be required until the tenancy agreement is made. Oral, written and implied agreements are all valid; a written agreement is required only when the landlord requires a guarantor or the tenancy includes tenant services. The standard residential tenancy agreement is Form 1.
We found no right to cancel a signed lease before move-in. A fixed-term tenant is otherwise responsible for the rent until the end of the term. Where a tenant abandons a unit, the landlord must endeavour to re-rent as soon as practicable and has a duty to minimize its losses (s.55(2), (3)); we found nothing on how that applies if you never move in, so ask the Residential Tenancies Branch.

Saskatchewan
We found no specific Saskatchewan rule on holding deposits. A security deposit may be required only when the tenancy agreement is entered into, and only one deposit per tenancy is allowed. Application fees are banned (s.23), and collecting future rent in advance is banned (s.40). Oral and implied agreements are covered, and a fixed term of three months or longer must be in writing (s.20).
We found no right to cancel a signed lease before move-in. A landlord claiming a loss must take reasonable steps to minimize it (s.8(2)). Ask the Office of Residential Tenancies if you are not sure whether money you paid should be returned.

Ontario
Ontario has no separate holding-deposit concept. Money paid before move-in is a rent deposit, which the landlord may require only on or before entering the agreement (s.106(1)), and it must be repaid if the tenant does not get vacant possession (s.107(1)). Application fees are banned (s.134(1)(a)). Most private tenancies must use the standard lease, which must be signed on or before the day the tenant may move in, though a lease not on the form is still valid (s.12.1(11)). Agreements are covered whether written, oral or implied.
We found no right to cancel a signed lease before move-in. When the LTB works out arrears owing, it considers whether the landlord took reasonable steps to minimize its losses (ss.88(4), 16). We found nothing on how that applies if you never move in.

New Brunswick
No section of the New Brunswick Act names holding deposits. The Act voids a requirement to pay any amount other than rent, a security deposit or a reasonable amount for services (s.8(4)). A written lease on the Standard Form is required (s.9(1)), and an unsigned or oral tenancy is deemed to be on it (s.9(5)). No section names application fees; s.8(4) may reach them, but we found no government statement that it does.
We found no right to cancel a signed lease before move-in. A tenant who leaves can face damages, including lost rent, and the landlord must mitigate to the extent contract law requires (s.11(4)). Ask a residential tenancies officer if you are unsure.

Nova Scotia
The provincial Renting Guide says any money taken by a landlord before the lease has been signed or before rent is due is considered a security deposit. The application fee is banned (s.6(1)), and the security deposit is capped at half a month. The standard form of lease (Form P) is mandatory (s.8(2A)); a written lease without the form, or an oral agreement, is treated as if the standard form was signed (s.8(4), (5)).
We found no right to cancel a signed lease before move-in. A tenant who leaves without proper notice stays responsible until the unit is re-rented, and the government's Ending guide says the landlord must make attempts to re-rent. Ask the Residential Tenancies Program how the deposit is treated in your case.

Prince Edward Island
Only one security deposit is allowed, the Act bars any other deposit (s.12(2)), and a separate holding deposit is not allowed. The application fee is banned (s.12(1)). From April 8, 2023, the landlord must prepare a written agreement (s.11(1)); oral and implied agreements are still covered.
We found no right to cancel a signed lease before move-in. An ordinary notice cannot end a fixed term early (s.55(3)(b)). If a tenant abandons the unit, the landlord must mitigate to the extent contract law requires (s.46). Contact the Rental Office if you paid money and are unsure whether it must be returned.
Newfoundland and Labrador
The Newfoundland and Labrador Act does not regulate holding deposits, and the Residential Tenancies Office has treated them as outside its jurisdiction because a rental agreement has not yet been entered into. Written, oral and implied agreements are all covered (s.2(h)). An implied agreement can arise when the tenant pays rent or a deposit and the landlord accepts it. The landlord must give written notice of an oral or implied agreement within 10 days (s.7(3)).
We found no right to cancel a signed lease before move-in. If a tenant abandons the unit, the landlord must mitigate to the extent contract law requires. Because a dispute over a holding deposit may fall outside the Office, get any release in writing.

Can a landlord change your move-in date?
Not on its own, in the Acts we reviewed. The start date is a term of the agreement, and in Alberta, British Columbia, Saskatchewan, Ontario, New Brunswick and PEI a term changes only if both sides agree, apart from the exceptions the Act sets out (such as a lawful rent increase). Alberta also writes into every tenancy agreement a promise that the premises will be available for occupation at the beginning of the tenancy, and in Ontario a rent deposit must be repaid if the tenant is not given vacant possession. We found no specific rule in any province covered here on a landlord delaying a move-in date, so ask for the new date in writing and contact your tenancy office if you are left without a place or out of pocket.
Can a landlord make me move in early?
We found no rule in the Acts we reviewed that requires a tenant to take a unit before the agreed start date. Because the start date is a term of the agreement, and terms generally change only if both sides agree, you can say no to an earlier date. SQRFT advice, not law: if you do agree, put the new date in writing along with whether you will pay rent for the extra days, since an early move-in can bring your rent obligations forward.
Can I get my security deposit back before moving in?
It depends on what the money was and why the move-in did not happen. In Ontario, a rent deposit must be repaid if the landlord does not give the tenant vacant possession (s.107(1)). In Nova Scotia, money taken before the lease is signed or before rent is due is treated as a security deposit, PEI allows only one security deposit per tenancy and bars a separate holding deposit, and in British Columbia the tenancy is considered established once the deposit is paid.
In Alberta and Saskatchewan we found no rule on holding deposits, the New Brunswick and Manitoba Acts have no section naming them, and Newfoundland and Labrador's guide says holding deposits are not regulated under its Act. SQRFT advice: ask in writing for a release that says what happens to the money, keep the reply, and see can a landlord keep a holding deposit.
