No Self-Help Evictions

A Newfoundland and Labrador landlord cannot legally evict a tenant by changing the locks, removing belongings, or shutting off utilities. Every eviction must go through the Residential Tenancies Division and end with a formal order.

No Eviction for Landlord's Own Use

Unlike many other provinces, Newfoundland and Labrador does not have a ground allowing a landlord to evict a tenant so the landlord or a family member can move in. This is a genuinely distinctive feature of NL's Residential Tenancies Act -- a tenant cannot be evicted purely because the landlord wants the unit back for personal use.

Filing and the Hearing

If a tenant disputes a notice to end the tenancy, or the landlord needs an order to enforce it, either side can apply to the Residential Tenancies Division. A hearing officer reviews the evidence from both sides and issues a written decision.

Enforcement

If a tenant doesn't leave after a final order to vacate, enforcement happens through the proper legal channel, not by the landlord personally removing the tenant or their belongings.
