No Self-Help Evictions
A Nova Scotia landlord cannot legally evict a tenant by changing the locks, removing belongings, or shutting off utilities. Every eviction must go through the Residential Tenancies Program and end with a Director's order -- self-help eviction is illegal even if the landlord believes they have good cause.
Filing and the Hearing
If a tenant disputes a notice to end the tenancy, or the landlord needs an order to enforce it, either side can apply to the Residential Tenancies Program. A hearing officer reviews the evidence from both sides -- the notice, any responses, and supporting documents -- and issues a written order.
Appealing an Order
A party who disagrees with a Director's order can appeal to the Small Claims Court within the time limit stated on the order (generally 10 days). The Small Claims Court hearing is a fresh review of the matter, not just a review of the Director's decision for errors.
Enforcement
If a tenant doesn't leave after a final order to vacate, the landlord must obtain an order for possession and have it enforced by the Sheriff -- the landlord still cannot remove the tenant or their belongings personally.
