How the Eviction Process Works in Ontario

From Notice to LTB Application
An eviction begins with a notice (see our guide on notice to end tenancy for the different N-forms). If the tenant does not comply with or dispute the notice, the landlord's next step is to file an application with the Landlord and Tenant Board (LTB). The application type generally matches the notice: an L1 application is used to evict for non-payment of rent and collect the rent owing, while an L2 application is used to end a tenancy and evict for other grounds (such as those covered by N5, N6, N7, N8, or N12).
Filing Fees
The LTB charges filing fees that vary by application type. As examples: an L1 application costs $201 by mail or in person, or $186 through the Tribunals Ontario Portal. An L2 application costs the same, $201 mail / $186 Portal. Note the Portal discount only applies to specific application types -- not every LTB form receives a discount for online filing.
The Hearing
Once an application is filed, the LTB schedules a hearing. Both the landlord and tenant have the right to attend and present evidence. Mediation is offered at most hearing locations as a less formal alternative to a full adjudicated hearing, and many disputes are resolved this way rather than through a contested hearing.

After the Hearing
The LTB issues a written order following the hearing. If the order requires the tenant to move out and the tenant does not do so voluntarily, only the Sheriff, through the Court Enforcement Office, can carry out a physical eviction. The landlord themselves can never change locks, remove belongings, or otherwise force the tenant out directly.
